Hi Ros,

Nice site you have here. I hope you can help answer my question:

As a foreign affiliate of merchants in the US, what "Tax Withholding Form" do I need to fill? There are so many of these forms I am really confused.

I am a foreigner with no business connections whatsoever in the US. If you can just tell me a bit about it I would appreciate it so much!

Hi Greenie,

We 'foreigners' (relative to the U.S. that is) have to fill in a W-8BEN form for our merchants.

W-8BEN Forms

Foreign person, non-resident alien or foreign national performing working outside the U.S must fill out a W-8BEN.

Foreign persons are not subject to U.S. income tax withholding if performing the work outside the U.S.

If you receive certain types of income, including prize money won in affiliate program contests, you must provide a Form W-8BEN to establish that you are not a U.S. person, and claim that you are the beneficial owner of the income for which Form W-8BEN is being provided.

Thank you Ros. Very kind of you to take the trouble to reply to this post.

However, I was given to understand by a certain party that if we foreigners do not physically carry out any business activity, own any equipment or have representatives doing so on our behalf in the US, then we are not obliged to fill in any W form. As an alternative in such cases, only a letter to the affiliate merchant stating this fact would suffice.

Would appreciate very much if someone can throw further light on this, as I think a letter is preferable to the highly technical and jargon-filled W form, which can easily lead to a wrongly-filled form without guidance.
